Following a contested hearing, a Scott County Judge granted Brent Schafer’s motion to dismiss all drug possession charges filed against his client. The Judge found that the arresting officer did have a legal basis to stop the vehicle Schafer’s client was occupying. The officer activated his red light after stopping behind a vehicle that was lawfully parked in a residential area with no basis to believe that the occupants of the vehicle had been engaged in criminal conduct.
